INITIAL STATEMENT
The customer declares that he/she has read through the following general terms of sales before placing an order on the website Vinavoce.com. By choosing to buy products online, he/she signifies his/her acceptance of the terms detailed below.
PRICES
All the prices in our catalogue are shown pre-tax in Euros and ex-cellars. They are given as an indication and are likely to be modified at any time without notice. Shipping costs are automatically calculated and appear on the purchase order. Their calculation depends on several factors, the weight (of the product, packaging...), the carrier, the country of delivery, and so on. The customer is committed to pay the current selling price at the time of validation of his/her order.
For all wines shipped outside France, the prices will be calculated, tax not included, automatically on the invoice. Custom duties and other local taxes, import duties or state taxes are likely to be claimed. These duties and amounts are not the responsibility of the company Vinavoce. They are the customer’s sole responsibility, in terms of declaration as well as payment to the authorities or competent bodies in the relevant country. We advise the client to inquire about these aspects with his/her local authorities.
PAYMENT
Payment of the purchase is carried out when placing the order by any of the following methods:
- secure online credit card payment (SSL Technology)
- bank check for deliveries within France only (then paying by a bank check that must be issued from a bank domiciled within France or Monaco) or International Money Order in Euro

Vinavoce.com ensures the customer’s purchase is made confidently and without any risk. When he/she makes his/her payment on our website Vinavoce.com, he/she is redirected to our bank’s secure server. All the data provided by the user during payment by credit card is encrypted using the SSL (Secure Socket Layer) protocol, which is the international standard for secure transaction. That way, the information exchanged cannot be intercepted or changed.
Only the bank has this information. The customer’s credit card number is always encrypted and will never circulate clearly on the web. Nobody can read it, and therefore nobody can use it illegally. These encrypted data is never recorded on our server. That is the reason why the purchaser has to enter it every time he/she shops at Vinavoce.com. Our bank acts as a trusted third party.
The goods sold remain our entire property, until full payment is made in accordance with the law n° 80335 of the 12th of May 1980, relating to ownership rights.
However, the buyer can also place his/her order by filling out the order form (printable version) and send it, along with the payment, to the following address: VINAVOCE, Service Clients - 31, rue Albert Varnet - 26000 VALENCE.
ORDER’S VALIDITY
The last "click" is deemed similar to the handwritten signature provided in article 1134 of the French Civil Code, hereinafter the "acceptance click" (law of March 13th, 2000 on the electronic signature). After this "acceptance click", the order is deemed irrevocable and may be cancelled only in the restrictive cases specified hereunder as “withdrawal rights” and “products’ availability”
The contractual information will be confirmed by e-mail at the address indicated by the customer in the purchase order. By keeping this e-mail and/or printing it, the purchaser has proof of his/her order, which the Company recommends he/she keeps.
By sending the order form, the client authorizes Vinavoce to debit his/her account with the full amount due for the order. The order will be processed only after the transaction has been authorized by the bank in case of payment by card, check or International Money order. We will send to the buyer a receipt by post and will confirm a delivery date.
Vinavoce Company notably reserves the right to refuse to make a delivery or to honor an order emanating from a consumer who would not have settled totally or partially a previous order or with whom a legal dispute of payment would be underway.
Within the framework of the order’s checking, the customer will have to send to the company Vinavoce, by fax or e-mail, a legible photocopy first side reverse of an ID card and of documentary evidence of place of residence. The order will be validated only after reception and check of these elements. Vinavoce has implemented this order check-out procedure to ensure no one is using someone else's banking information without their knowledge.
Our company cannot accept orders received from countries which forbid the direct shipment of wines and spirits to private individuals.
SHIPPING COST
ALL GOODS ARE SENT CARRIAGE PAID IN FRANCE. These costs are calculated automatically and are explicitly added to the order form.
INTERNATIONAL SHIPPING COST: Shipping cost varies according to the type of transport, place of delivery, the number of bottles ordered and oil increases. Please consult us for further details.
PRODUCTS’ AVAILAIBILITY
In case of unavailability of products ordered, notably due to our suppliers, the customer will be informed as soon as possible and will be able to cancel the order. The latter will therefore have the choice to either have the amount refunded within 30 days upon receipt, or else, exchange for products with equivalent characteristics and prices, only as long as Vinavoce may be able to provide so.
If the exchange is impossible, Vinavoce reserves the right to cancel the order and to refund the client with the amount paid.
The information regarding the products’ availability being provided by our suppliers, Vinavoce shall not be held liable in the event that an item is unavailable for shipment nor shall such instances result in the payment of compensation for damages to the purchaser.
DELIVERY
Goods ordered from the company are sent by registered parcel post (for deliveries in France we choose the Colissimo fast delivery service of the French Post). In France, the usual maximum delay is 8 working days from the day the purchaser's banking details have been validated and the payment has been received. Once the order has been shipped by the carrier, the client will receive a confirmation email of his/her shipping details.
INTERNATIONAL DELIVERY
For deliveries outside of France, a specific quote will be provided. Vinavoce will do its best to deliver as fast as possible to the address supplied by the customer. Consequently, the average delivery time will depend on the destination.
All order irregularities (damages, item missing in comparison to the delivery form, damaged packages, broken items…) must be indicated on the delivery order under “hand-written reserve” that the customer will then have to sign and let the carrier as well as Vinavoce know about within 2 working days.
We shall not be held liable if the delivery is impossible for any reason beyond our control such as absence, error of title (description) in the address, unavailability due to stock, etc..
RETURNS
According to the article L121-16 of the French Code of Consumption, the customer enjoys a period of 7 working days after the delivery of his/her order to return the wines for exchange or refund, without penalty, except for the shipping cost that will be at the risk and expense of the client. This period runs from the delivery date of the order. If this deadline expires on a Saturday, a Sunday, an official holiday or nonworking day, the period shall be extended until the first working day that follows.
Any return must be reported in advance by email to Vinavoce’s customer service (contact@vinavoce.com). A return authorization number will be allocated to the product. Wines must be sent back by registered parcel post (for deliveries in France we choose the Colissimo service of the French “Poste”). In all cases, for the customer to benefit from the withdrawal right, the return shipment is by mail, in its original packing and in a perfect state, with the corresponding invoice, to:

Products must be returned in their entirety with their complete and intact original packaging, including the original invoice, and in perfect condition for resale. Products that have been damaged or which original package has been damaged, will not be refunded, nor exchanged.
This right to withdraw the order will be exercised without any penalty except for the return shipping cost. If a user chooses to exercise this right, he/she may request a refund for the amount they paid, or ask for the product to be exchanged. In the case of an exchange, the re-shipment will be at the customer’s expense.
If the withdrawal right is exercised, Vinavoce will do its best to refund the customer within 15 days. If the order has been paid by credit card, the customer will then be refunded by crediting his bank account (secure transaction), or by bank check in other cases or payment methods.
A return of goods due to an inaccurate address or an impossible delivery for a reason not imputable to Vinavoce will be re-invoiced.
APPLICABLE LAW
The original language of this agreement is French. The present Terms and Conditions of Sales are subject to French law. If dispute or litigation happens, only the Romans-sur-Isère Commercial Court will be sole competent, even in the case of multiple defendants or third-party proceedings.
MINORS AND LEGAL COMPETENCE
Under Order No. 59-107 of 7 January 1959 and Law No. 74-631 of 5 July 1974, the sale and supply of alcoholic beverages to minors and similar categories is prohibited. Consequently by filling the order form the customer acknowledges having the legal competence to enter into this contract.
